Quarantine And Child Visitation During Spring Break

It is not surprising that many parents in and around Fort Worth, TX, are wondering about the impact of COVID-19, quarantine recommendations, and travel for the upcoming spring break.

While school is not in session, current visitation orders are based on the school schedule and calendar. This means that the child’s current schedule for spending time with both parents continues to be in place. The Texas Supreme Court published their second emergency order regarding this pandemic, which states that the original school calendar, not any extended school breaks, controls the exchange of the child or children.

The ruling by the Texas Supreme Court eliminates concerns about the spring break exchange of the child or children. As most divorce decrees have alternative possession on odd or even years, this was a very concerning issue for both parents as well as child support attorneys in the state.

Upcoming Concerns

For the future exchange of the children based on an existing court order, talking to your family law attorney or discussing your options with child support attorneys before making any changes to the visitation schedule is recommended.

Failing to let the child or children go to the parent can result in a motion filed against you. However, if there are genuine fears of the coronavirus and exposure for the children, the advice of child support attorneys can be essential to building a case about why the decision was made.

While the Texas Supreme Court has continued to provide emergency orders that provide guidance for families, there is still some confusion. The seventh emergency order states that the exchange of the child is not controlled or impacted by a shelter-in-place order or any other local orders that limit travel.

Parents in Forth Worth, TX, should work together, whenever possible, to coordinate the safe exchange of their children. When parents agree on modifications to the order, the court does not need to be involved, making it easy to ensure the child has access to both parents in a way that works for the family.
